Booking & Participation Agreement

These Terms & Conditions govern your booking and participation in any trip, expedition, or activity operated by Yacana Expediciones y Cultura S.A.S. de C.V. ("Yacana," "we," "us"). By booking a trip, paying a deposit, or taking part in an activity, you confirm you have read, understood, and agreed to these terms on behalf of yourself and everyone in your party.

02 Our services

We provide guided mountaineering, hiking, climbing, and related outdoor experiences in Mexico and, on request, internationally. Trip details — including itineraries, routes, timings, inclusions, and guides — are described on our website and in your quote, and are indicative. We may adjust any part of a trip before or during the activity where reasonably necessary for safety, weather, group ability, permits, or conditions on the mountain. Summiting is never guaranteed.

03 Booking and payment

Deposit
35% of the trip price is due to confirm your booking and secure your guide and date.
Balance
65% is due at the end of your trip.
Currency & fees
Prices are in USD. Cash is accepted with no fee; card payments carry a 5% bank fee on the remaining balance.

Your booking is only confirmed once we receive your deposit and send written confirmation. Prices are subject to change until a deposit is received.

04 Cancellations and changes by you

  • 14 or more days before the trip: full refund of any amount paid.
  • Fewer than 14 days before the trip: the deposit is non-refundable.
  • No-show or early departure: no refund.

Date changes are subject to guide and availability and should be requested as early as possible. Refunds are returned via the original payment method where possible.

05 Cancellations and changes by us

Your safety comes before any summit. Your lead guide has full authority to delay, shorten, reroute, turn around, or cancel any activity — before or during the trip — where conditions, weather, or safety require it. If we cancel a trip before it begins for reasons within our control, you may choose a full refund or a reschedule. For cancellations or changes caused by weather, mountain conditions, or other circumstances beyond our control (see Force Majeure), we will offer a reschedule or a credit where reasonably possible; refunds in those cases are at our discretion and may exclude non-recoverable third-party costs already incurred (such as transport, lodging, or permits).

06 Assumption of risk

Please read carefully

Mountaineering, high-altitude climbing, hiking, and related activities are inherently dangerous. They carry real risks that cannot be eliminated even with professional guiding — including, without limitation, altitude sickness and its severe forms, falls, rockfall, avalanche, extreme cold and weather, exhaustion, equipment failure, remoteness from medical care, and serious injury or death.

By booking and participating, you acknowledge that you understand these risks, that you are taking part voluntarily, and that you accept the inherent risks of the activity. You confirm that you are participating with full awareness of the dangers involved. Where we require it, you (and any minor's parent or guardian) will also sign a separate liability waiver and health questionnaire before the trip; participation is conditional on completing these.

07 Your health, fitness, and honesty

You are responsible for being honest and complete about your fitness, experience, and medical condition on our questionnaire and waiver. This information is used to keep you safe. Choosing a trip suited to your ability is a shared responsibility, but the final decision to attempt — or continue — an activity rests on accurate information from you. Your guide may decline or stop your participation at any point if, in their judgment, continuing would put you or the group at risk; no refund is due in that case.

08 Insurance

We strongly recommend, and for higher peaks may require, that you hold your own travel and medical insurance that covers mountaineering at the altitudes of your trip, including emergency evacuation and repatriation. You are responsible for arranging and paying for your own insurance. Yacana is not responsible for costs arising from your lack of adequate insurance.

09 Conduct on the trip

You agree to follow your guide's instructions at all times, particularly on matters of safety, pace, and route. We may remove any participant whose behavior is unsafe, disruptive, or who is unfit to continue (including through intoxication), without refund and at the participant's own onward cost.

10 Minors

Participants under 18 may join suitable trips only with the consent and, where we require it, the accompaniment of a parent or legal guardian, who accepts these terms and signs the waiver and health forms on the minor's behalf.

11 Equipment

We provide the technical group and safety equipment listed for your trip. You are responsible for bringing the personal items on your trip's gear list, and for using provided equipment with care. You may be liable for the repair or replacement cost of provided or rented equipment lost or damaged through misuse or negligence. Personal-gear rentals can be arranged on request and are subject to availability.

12 Photographs and media

We may take photographs and video during trips and use them in our marketing and on our website and social media. If you prefer not to appear, tell your guide or email us — see our Privacy Policy for details and how to opt out.

13 Third-party providers

Some elements of your trip — such as transport, lodging, mountain refuges, and park access — are provided by independent third parties. While we choose our partners with care, we are not responsible for their acts, omissions, or independent failures, and their own terms may apply.

14 Limitation of liability

To the fullest extent permitted by applicable law, Yacana's liability arising out of or in connection with your trip is limited, and we are not liable for loss, injury, damage, or delay resulting from the inherent risks of the activity, from circumstances beyond our reasonable control, or from your own acts, omissions, or failure to follow guide instructions or these terms. Nothing in these terms excludes or limits any liability that cannot lawfully be excluded or limited.

15 Force majeure

We are not liable for any failure or delay caused by events beyond our reasonable control, including weather, mountain or road conditions, natural events, volcanic activity, illness or epidemic, strikes, government or park action, permit changes, or transport disruption.

16 Governing law

These terms are governed by the laws of Mexico. Any dispute will be subject to the competent courts of Mexico City (Ciudad de México), without prejudice to any mandatory consumer-protection rights you may have where you live.

17 Changes to these terms

We may update these terms from time to time. The version that applies to your trip is the one published on this page when you book, always shown with its "Last updated" date.
